Car was taken for repossession less then a week ago..the payment was only two months behind we had called to make payment arrangements we where consistent with the payment arrangements but the vehicle was still taken…the vehicle was towed to an unknown physical address at this time for the price of $750 that is NOT including the storage fee’s (about an hr drive from home)..is there anything that can be done about that fee’s and what about the car still being taken and we where making payments under the arrangement

My boyfriend lost his job and can no longer pay for his used vehicle he got a few years ago. He tried to make a deal with them but told him they would be repossessing his car soon. This morning he came home to find them repossessing his car. He yelled at them for breaking the lock on his gate and started to swear at him. He then said they pushed them and handed him a paper about his repossession and what he still owes. His dad was his witness to this as well and he went to file a police report and the police said they will look into it.

I was trying to find if this was lawful or not (for them damaging property and assaulting him) and I discovered breaching the peace. It says if they assault (it says any type of touching including pushing) it is breaching the peace. It also says if they enter a closed garage or gate that is locked, it also counts to breaching the peace. His car was locked behind a gate in front of his garage, so I don’t know if this counts. I’m trying to find out more info into seeing if the repo men actually did breach the peace according to our state’s laws (Michigan). Can anyone point me in the right direction?
