How Long Do I Have Until Foreclosure?
My boyfriend just passed away in December and we bought a house in May of 2007 but the house is in his name and his family doesn’t want anything to do with it. What can I do?
If my only option is to wait until it goes to foreclosure then how long do I have till me and my son have to go back to a small, crappy apartment which I will ****?

Wow…I am sorry to hear that.
My wife used to work in the mortgage industry and there are lots of complications in getting help when you aren’t even on the title. The only suggestion I could make is to contact whatever company services your mortgage and ask them what you can do. They usually have payment plans to help you and they can help you figure out an option.
Foreclosure time depends on where you live. In most places it is 3 months.

You probably have a month or two before they start the process. You will then have about 3-12 months before the process is complete. It depends on where you live. You should just get your own financing and buy the home if you want to stay there.

This is an open question that could go many different ways.
1. How long were you with your boyfriend and does you state have a comon law mariage?
2. Were you one the mortgage with your boyfriend?
3. Is your son also the son of your boyfriend?
Answering those questions may lead you down various paths to your needs.
Making the assumption that you do not have a comon law situation, you are not on the mortgage or deed or note and your son is not his.
In this case, most foreclosure START at the 3rd month of delinquency. At that point, you will want to contact the mortgage company and let them know that the mortgagor (your boyfriend) is deceased…this may buy you another 30-60 days. In terms of how long you have…it really depends on the county in which you live. Typically, you could be looking at 6-9 months based on how busy your county is with foreclosures. Here in Franklin County, Ohio…it is running about 9 months.
Whichever way you go…you may end up having to speak to an attorney.

First I would like to share my condolences. You will get a couple of months because it is a process and not an event. I’m wondering why his family is not doing nothing about it. There must be some equity in the house for your son to inherit. Again, sorry for your loss. I’ve gone through a similar situation.
