Did the repossession man break breach of peace and/or privacy rights?

So i did the wrong thing and was late on my car payments, which resulted in a repossession to be issued on my car. I quickly got my payments up to date and got that status off, and fortunately i was not home when he came. The problem is he came at 6:45am and woke up my roommate and his girlfriend, and after they told him i was not home, he proceeded to wake up my apartment management and tell them the situation, and how much was owed ect. My roommate over heard the conversation and the repo man told them to not say anything about the conversation and that he told them. Is this a breach of peace at 6:45am or Privacy due to telling 3rd party people about it?

    I see no reason why the repo man has to talk to anyone. All they are supposed to do it take your car. You deal with the bank regarding payments etc.

    It’s a violation of third party disclosure laws, I’d get your roommate and your landlord to write statements asap and contact an attorney.

    Wow no kidding? If everything you have said is 100% true, he he he he and add a tee hee hee in there.

    To start with any person acting as an agent for a finance company and or bank can not contact you before 9:00 AM or later than 9:00 PM, that is the law. Period. If the repo guy / girl (in my case) is at your house and you come out no matter what time it is, you are the one who initiated contact and therefore they can speak to you.

    Issue 2~ If your payments were current your finance company should have pulled the order in a timely fashioned. When payments are made current the order should be pulled within 30 minutes for 2 reasons. 1) So your car is not picked up and 2) So the repo company is not wasting time and energy chasing a car that is not up for repo. If this was not done in a timely manner you have an issue with your finance company that they need to address with you, and do not take any B.S. From them. Demand that they send you a copy of the order as well as a copy of the order to not pick up the unit. They have to if you ask for it under the consumer protection laws governing repossessions.

    Issue 3~ And the most important one, the one that pretty much has you in court winning the maximum award of 50,000.00 if of course you were 100% in the right about everything you said.
    A REPRESSOR CAN NOT SPEAK TO ANYONE OTHER THAN THE X OR CO-X ABOUT THE DEBT. Now they can go to your office manager and ask if you live there and if the manager gives them any information you can haul them into court. Was there an offer to exchange money for information? I can go to your neighbor and say,” Do you know if Jane still lives next door?” “Do you know if she still drives that Corvette?” I can not say, “Hey since you know Jane, let me tell you this, she is way behind on her car payment, I need to pick up that car, here is 20.00, call me when she gets home.”

    You pretty much have the repo company by the ***. The driver well that’s another story. He will as he needs to be, just get fired, no money there. But the company holds a surety bond, they have this bond for people like you who have been done 100% wrong to tap. The maximum you can get from this bond is 50,000.00.

    As far as knowing about you, you have to understand the kind of people we deal with on a daily basis. Pretty much the scum of the earth. Theifs (ID and other) drug dealers, murders, child molesters, you get the idea. So when we go outto pick up a unit we want to know as much as we can about the person we are dealing with. Anything we find out about people is done through public records, totally legal.
